and Eligibility Terms

1. About these Terms

These Creator Application and Eligibility Terms govern the submission and review of an application through Hashtag BIO / hashtag.bio for possible creator opportunities, brand campaigns, events, partnerships, ambassador programmes or participation in the Hashtag Bio Inc. network.

These Terms apply only to the application stage. They are not a campaign agreement, talent-management agreement, employment agreement, agency appointment, exclusivity agreement or promise of paid work.

Hashtag Bio Inc. operates the application and is the party to these Terms. Miss Denmark branding identifies a campaign collaboration but does not make Miss Denmark a party to a general Hashtag Bio Inc. creator-network application.

2. Who these Terms are with

The contracting entity is:

United States office: 2021 Guadalupe Street, Suite 260, Austin, Texas 78705, USA

Legal contact: legal@hashtag.bio

Application support: support@hashtag.bio

Telephone: +1 888-246-0148

The application page is co-branded with Miss Denmark. Hashtag Bio Inc. receives and reviews the general network application. Miss Denmark does not become a contracting party or receive the application merely because its branding appears on the page. If Miss Denmark separately offers an opportunity, receives applicant information or enters into an agreement with an applicant, the applicant will receive a specific notice and clearly identified additional terms.

3. Accepting these Terms

By selecting the checkbox confirming agreement and submitting an application, the applicant agrees to these Terms. The applicant should download or retain a copy.

The application interface must present a reasonably prominent link to these Terms before submission and must record the version accepted, date and time of acceptance and the applicant's affirmative action.

Privacy acknowledgement and optional marketing consent must remain separate from acceptance of these Terms.

4. Eligibility

An applicant must:

  • Be at least 13 years old and meet any higher minimum age required in the applicant's country.
  • If under 18 or otherwise lacking full contractual capacity, involve a parent or legal guardian and provide verifiable authorization before acceptance, verification, campaign participation, payment or another binding commitment.
  • Apply personally or have documented authority to act for the creator identified in the application.
  • Provide a social-media profile that the applicant owns, controls or is authorized to represent.
  • Provide accurate, current and sufficiently complete information.
  • Comply with applicable law when submitting information or materials.

Eligibility to apply does not mean that the applicant is eligible for every opportunity. An opportunity may have additional age, location, audience, category, availability, verification, brand-safety or legal requirements disclosed separately.

5. Application information

The application may request the applicant's name, contact details, country, primary social-media platform, social handle, public profile link, follower range, creator category, description of content, goals and preferred opportunities.

Applicants should not submit government identification, financial information, health information, biometric information or unrelated sensitive information unless a separate, clearly identified and lawful verification process specifically requests it.

Personal information is handled as described in the Privacy Policy and Creator Application Privacy Notice. These Terms do not replace that notice or create consent for processing that requires a separate legal basis.

6. Accuracy and updates

The applicant confirms that submitted information is accurate to the best of the applicant's knowledge and is not misleading by omission. The applicant must not impersonate another person, inflate or purchase engagement for the purpose of misleading reviewers, falsify audience information or submit a profile without authority.

If material information changes while an application remains active, the applicant should notify support@hashtag.bio. Hashtag Bio Inc. may request reasonable clarification or evidence.

7. Public profiles and publicly available information

By supplying a social-media handle or profile link, the applicant authorizes reviewers to access and review information the applicant has made publicly available for the limited purposes of confirming authenticity, understanding the content category and assessing suitability for potential opportunities.

This authorization does not permit access to private accounts, circumvention of platform controls or collection of unrelated sensitive information. Any connected-account analytics, private data access or third-party verification service requires separate disclosure and any authorization required by law or the relevant platform.

8. Application review and selection

Applications may be reviewed against reasonable criteria relevant to the network or a particular opportunity. Criteria may include completeness, authenticity, content category, audience characteristics, geography, availability, brand fit, professional conduct, legal restrictions and fraud or impersonation risk.

Hashtag Bio Inc. is responsible for reviewing and deciding general creator-network applications. Applications are reviewed by authorized team members. Miss Denmark may participate only in a separately identified Miss Denmark opportunity, after the applicant receives notice of that role. Review criteria must not be applied in a manner prohibited by applicable law.

The reviewing organization may accept, decline, pause or request further information about an application. It is not required to disclose confidential brand criteria, security methods, third-party confidential information or legally protected internal assessments.

9. Verification

The current application form does not require identity documents, facial verification or biometric information. If an applicant advances to an opportunity requiring identity verification, Hashtag Bio Inc. may use Sumsub or another provider identified in an advance notice. The applicant will receive information describing the verification method, provider, purpose, applicable terms and privacy treatment before information is collected.

Refusal to complete an optional verification process will not be treated as consent. Where verification is genuinely necessary for an opportunity, the effect of declining must be explained before information is collected.

10. Application communications

The applicant may receive operational communications reasonably necessary to acknowledge, assess, clarify or determine the current application. These communications are part of application administration and are distinct from promotional marketing.

The applicant is responsible for maintaining accurate contact information and for checking reasonable message filters. Delivery of an electronic message is not guaranteed.

11. Future opportunities and marketing

Agreement to these Terms does not constitute consent to newsletters, promotional marketing or future-opportunity alerts.

Where required, future promotional communications must be based on a separate optional choice. Refusing or withdrawing that choice must not disadvantage the current application. Email, SMS, telephone and WhatsApp choices must be separated where required by applicable law.

12. Prohibited conduct

An applicant must not:

  • Submit false, deceptive, fraudulent or unlawfully obtained information.
  • Impersonate another person or misrepresent authority over a profile.
  • Upload malicious code or interfere with the website or application process.
  • Attempt to bypass security, rate limits or access controls.
  • Use automated means to submit applications at scale without written authorization.
  • Submit content that is unlawful, threatening, defamatory or that infringes another person's rights.
  • Offer money, gifts or other improper benefits to influence an application decision.

13. Applicant content and limited review licence

The applicant retains ownership of application text, portfolio material and other original content submitted with the application.

The applicant grants the responsible reviewing entities a non-exclusive, worldwide, royalty-free and limited licence to host, copy, display internally and review submitted content only as reasonably necessary to administer the application, assess potential opportunities, maintain lawful records and address security or legal claims.

This limited licence does not authorize public publication, advertising use, commercial reuse, modification for a campaign, model training or sublicensing to brands for promotional use. Any such use requires a separate agreement and, where applicable, separate permission.

14. Rights of other people

The applicant must have the rights and permissions necessary to submit application content. The applicant should not submit confidential information, private communications or personal information about another person unless authorized and legally permitted.

If a rights holder raises a credible concern, the reviewing organization may restrict access to or remove the relevant material while the concern is assessed.

15. Hashtag BIO materials

The website, application form, names, logos, interface, text and other materials supplied by the website operator or its licensors are protected by applicable intellectual-property laws. No ownership is transferred to an applicant.

Applicants may use the application interface only for its intended purpose. These Terms do not grant permission to use the Hashtag BIO, Hashtag Bio Inc. or Miss Denmark names, logos or branding in public communications.

16. No agency, employment or representation

Submitting or accepting an application does not create employment, agency, partnership, joint venture, fiduciary duty, management representation, exclusivity or authority to bind any organization.

An applicant must not claim to be an employee, representative, ambassador or approved member unless a separate written agreement or official written confirmation expressly grants that status.

17. No guarantee of acceptance or opportunity

Submitting an application does not guarantee acceptance into a network, an invitation, a campaign, an event, compensation, minimum work, brand exposure, account verification, audience growth or any other commercial result.

Opportunity availability depends on factors outside the application process, including brand needs, geography, timing, eligibility, budget and lawful selection criteria. No statement on the application page should be interpreted as a guaranteed result.

18. Separate terms for campaigns and services

Any campaign, event, partnership, ambassador appointment, paid service, creator membership, platform account or public creator profile must be governed by a separate agreement or clearly identified additional terms before it begins.

Those additional terms should address deliverables, deadlines, approvals, advertising disclosures, compensation, expenses, taxes, intellectual property, content usage, exclusivity, conduct, measurement, cancellation and dispute arrangements as applicable. If additional terms conflict with these Terms for a specific opportunity, the additional terms control only for that opportunity.

19. Withdrawal, rejection and closure

An applicant may withdraw an application by contacting support@hashtag.bio. Withdrawal does not require deletion of information that must lawfully be retained for security, compliance, disputes or proof of the request.

An application may be rejected or closed where it is incomplete, ineligible, fraudulent, misleading, unlawful, duplicative, inconsistent with relevant opportunity criteria or associated with prohibited conduct. A decision may also be made because no suitable opportunity is available.

The current application decision is made by authorized team members. Automated tools may help organize records, identify duplicates or suggest opportunity matches, but Hashtag Bio Inc. does not make an acceptance or rejection decision based solely on automated processing that produces legal or similarly significant effects.

20. Privacy

The Privacy Policy and Creator Application Privacy Notice explains who is responsible for personal information, the information collected, purposes, legal bases, sharing, retention, international transfers and privacy rights.

If these Terms and the privacy notice appear inconsistent on a personal-information matter, the privacy notice governs that matter, subject to applicable law.

21. Electronic records and acceptance

The parties agree that the application, checkbox acceptance and related records may be created and retained electronically where permitted by applicable law. The applicant may request a copy through support@hashtag.bio.

Nothing in these Terms requires an applicant to consent to marketing or to waive a right that cannot lawfully be waived.

22. Changes to these Terms

The terms applying to an application are the version presented when the applicant submits it. A material change will not be applied retroactively to an already submitted application where doing so would unfairly reduce the applicant's rights or increase obligations.

Updated terms may apply to a new application or a new opportunity after reasonable notice and any fresh acceptance required by law.

23. Website availability and application errors

The website operator may maintain, update or temporarily suspend the application service. It does not guarantee uninterrupted availability or that every transmission will be error-free.

This section does not exclude responsibility for failing to use reasonable care, for a security obligation imposed by law or for any liability that cannot lawfully be excluded.

24. Responsibility and limits of liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any other liability that applicable law does not permit to be excluded.

Subject to those mandatory protections, Hashtag Bio Inc. is not liable merely because an application is unsuccessful or no opportunity becomes available. To the extent permitted by law, it is not responsible for indirect or consequential loss that was not reasonably foreseeable when the application was submitted.

These Terms do not impose a monetary liability cap on consumers and do not contain a class-action waiver. A later campaign or business agreement may contain its own proportionate liability terms.

25. Mandatory rights and fair terms

These Terms do not remove rights available under mandatory consumer, contract, equality, accessibility, privacy or other applicable law. If an applicant qualifies as a consumer, protections that cannot lawfully be waived remain effective.

If a provision is unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue where legally possible. Ambiguous standard terms will be interpreted as required by applicable law.

26. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except where mandatory law requires another result.

A governing-law or forum clause must not deprive an applicant of mandatory protections or access to a court or regulator available under applicable law. These Terms do not require private arbitration or waive collective or representative remedies.

Before starting formal proceedings, an applicant may contact legal@hashtag.bio so the concern can be reviewed. If a dispute is not resolved, proceedings may be brought in a court with lawful jurisdiction. Consumers may use the courts and remedies available under mandatory law in their place of residence. This informal step does not suspend a legal limitation period or prevent urgent or regulatory action.
