1. About these Terms

These Website Terms of Use govern access to and ordinary use of Hashtag Bio Inc. / hashtag.bio, including viewing website content, following links and using publicly available website functions.

Creator applications are additionally governed by the Creator Application and Eligibility Terms. Personal-information practices are described in the Privacy Policy and Creator Application Privacy Notice. If a specific service or opportunity has separate terms, those terms apply to that service or opportunity.

Hashtag Bio Inc. operates Hashtag.bio and is responsible for these Terms. The Miss Denmark branding on the creator-application page identifies a campaign collaboration and does not, by itself, make Miss Denmark the website operator or a party to these Terms.

The creator-application page is co-branded with Miss Denmark. Unless a specific opportunity notice states otherwise, Hashtag Bio Inc. operates the page, receives the application and is responsible for statements about the Hashtag Bio Inc. creator network. Miss Denmark remains responsible for its own name, logo and separately issued communications.

3. When these Terms apply

A visitor should review these Terms before using the website. Continued use after a reasonably prominent notice may indicate acceptance only to the extent recognized by applicable law.

Where the website asks a user to create an account, submit an application, purchase a service or accept additional obligations, the relevant terms must be presented through a clear affirmative acceptance process. A footer link alone must not be treated as proof that a user accepted unrelated material obligations.

4. Website purpose

Hashtag BIO currently provides information about creator and influencer opportunities and a form through which eligible creators may apply for consideration.

The website does not currently provide, under these Terms, a public creator marketplace, payment service, employment service, talent-management appointment, guaranteed campaign-placement service or public user-content hosting service. Any such future service requires separate terms and updated disclosures before launch.

5. Eligibility and minors

General informational pages may be viewed by visitors who can lawfully use them. The website and creator application are not intended for children under 13.

Applicants aged 13 to 17 may submit a creator application only where this is lawful in their country. Before acceptance, identity verification, public-profile activation, campaign participation, payment or another binding commitment, Hashtag Bio Inc. may require verifiable authorization from a parent or legal guardian.

A person who lacks legal capacity to agree to binding terms must use functions requiring contractual acceptance only with the involvement and legally valid authorization of a parent, guardian or other authorized representative.

6. Permitted use

Visitors may access and use the website for lawful, personal or legitimate professional purposes connected with learning about Hashtag BIO, Hashtag Bio Inc., Miss Denmark or available creator opportunities.

Permission to use the website is limited, non-exclusive, revocable where legally permitted and does not transfer ownership of website materials.

7. Prohibited use

A visitor must not:

Use the website for an unlawful, fraudulent, deceptive, abusive or harmful purpose.
Attempt to gain unauthorized access to the website, servers, accounts, forms or connected systems.
Probe, scan or test vulnerabilities without prior written authorization.
Introduce malware, harmful code, excessive traffic or a denial-of-service condition.
Circumvent access controls, security measures, rate limits or technical restrictions.
Impersonate another person or misrepresent an affiliation with Hashtag BIO, Hashtag Bio Inc. or Miss Denmark.
Harvest personal information, contact details or social-profile information without a lawful basis and authorization.
Use bots, scrapers or automated extraction tools in a manner that disrupts the service, violates applicable law or exceeds written permission.
Copy, frame, mirror or republish substantial website material except as permitted by law or written authorization.
Use website content or branding to train a commercial model, create misleading endorsements or suggest an unauthorized partnership.

Security research and accessibility testing must be conducted only through an authorized process disclosed by the website operator or with prior written permission.

8. Website content

Website content is provided for general information. Reasonable efforts should be made to keep material accurate and current, but opportunity details, dates, eligibility requirements, availability and third-party information may change.

Visitors should verify information that is important to a legal, financial, professional, travel or commercial decision. Website content is not legal, financial, employment, tax or professional advice.

Nothing on the website guarantees acceptance into a creator network, campaign participation, payment, audience growth, brand exposure, verification or another commercial outcome.

9. Creator opportunities and applications

Information about a possible opportunity is an invitation to learn more or apply. It is not a binding offer unless a clearly identified authorized representative expressly states otherwise in a separate written agreement.

Submitting the creator application is governed by the Creator Application and Eligibility Terms. If selected for an opportunity, the creator must receive separate terms covering deliverables, approvals, compensation, expenses, taxes, advertising disclosures, intellectual property, content usage, cancellation and other relevant obligations.

10. No employment, agency or representation

Website access, application submission, application acceptance or informal communication does not by itself create employment, agency, partnership, joint venture, fiduciary duty, management representation, exclusivity or authority to bind an organization.

A person must not publicly claim to be an employee, representative, ambassador, approved creator or partner unless that status has been expressly confirmed through an authorized written communication or separate agreement.

11. Intellectual property

The Hashtag.bio website design, text, graphics, software, databases and Hashtag Bio Inc. branding are owned by Hashtag Bio Inc.. or its licensors. Miss Denmark owns or licenses its own name, logo, photographs and other materials supplied for the co-branded page. Third-party material remains the property of its respective owner.

Except for the limited permission to use the website, no intellectual-property right or licence is granted. Visitors must not remove rights notices or use protected material beyond an applicable legal exception without permission.

Hashtag Bio Inc., Miss Denmark and associated names and logos must not be used in a way that suggests sponsorship, endorsement, certification or affiliation without written authorization.

12. Visitor submissions and feedback

A visitor retains ownership of original feedback or non-application material voluntarily submitted through an authorized contact channel.

The visitor grants the recipient a non-exclusive, worldwide, royalty-free and limited licence to receive, copy internally and evaluate that submission for the purpose for which it was sent. This limited licence does not authorize public advertising use or commercial reuse of portfolio or creator content.

Visitors should not send confidential business ideas, trade secrets or material for which they lack rights. Creator-application content is governed by the Creator Application and Eligibility Terms.

13. Third-party websites and social-media services

The website may link to or display material from social-media platforms, brands, event providers or other independent services. Links are provided for convenience and do not automatically mean that the website operator controls, endorses or guarantees the third party.

Third-party services operate under their own terms, privacy notices, accessibility arrangements and security practices. Visitors should review those documents before interacting with the service.

14. User content and public profiles - not currently enabled

The application-only website does not currently provide a public user-content feed, public creator profile, comments area, messaging system or marketplace.

Before enabling user-hosted content, the operator must adopt suitable content rules, reporting and appeal mechanisms, intellectual-property procedures, moderation disclosures and any legally required transparency under the laws applicable to the service.

15. Copyright and rights concerns

A person who believes website material infringes copyright, trademark, privacy, publicity or another legal right may contact legal@hashtag.bio with sufficient information to identify the material, the right asserted and the requested action.

The website must not claim a United States statutory safe harbor, registered DMCA agent or formal notice-and-takedown status unless the relevant legal requirements and registrations have been confirmed.

16. Privacy and cookies

The Privacy Policy and Creator Application Privacy Notice explains personal-information practices. The Cookie Policy should identify cookies and similar technologies, their purposes, providers and durations.

Non-essential technologies must be controlled through an appropriate consent mechanism where required. These Terms do not create consent for marketing, analytics, targeted advertising or sensitive-data processing.

17. Website availability and changes

The operator may maintain, update, change or temporarily suspend the website where reasonably necessary for security, legal compliance, maintenance or service improvement.

The operator does not guarantee uninterrupted access or that every transmission will be error-free. Reasonable efforts should be used to avoid unnecessary disruption and to protect submitted information.

18. Security

Visitors must use reasonable care when accessing the website and must promptly report suspected security vulnerabilities or unauthorized access to support@hashtag.bio.

No transmission or storage method is completely secure. Nothing in these Terms reduces a security obligation imposed by privacy, consumer or other applicable law.

19. Suspension or restriction

The operator may restrict or suspend access where reasonably necessary to address security threats, unlawful conduct, material breaches, fraud, service disruption or legal requirements.

Where practical and legally appropriate, the operator should provide notice and an opportunity to clarify or correct the issue. This section does not authorize arbitrary discrimination or retaliation for exercising a statutory right.

20. Disclaimers

The website and its general informational content are provided on an 'as available' basis. To the extent permitted by law, no additional warranty is made that the website will meet every visitor's requirements or produce a particular result.

This disclaimer does not exclude obligations or warranties that cannot lawfully be excluded, including applicable consumer protections or duties to use reasonable care.

21. Responsibility and limits of liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any other liability that applicable law does not permit to be excluded.

Subject to mandatory protections, the operator is not liable merely because an application is unsuccessful, an opportunity changes or a third-party website is unavailable. To the extent permitted by law, the operator is not responsible for indirect or consequential loss that was not reasonably foreseeable when the visitor used the website.

These Terms do not impose a monetary liability cap on consumers and do not contain a class-action waiver. Any separate business agreement may contain its own proportionate liability terms.

22. Mandatory rights and fair terms

These Terms do not remove rights available under mandatory consumer, contract, equality, accessibility, privacy or other applicable law.

If a provision is unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue where legally possible. Ambiguous standard terms will be interpreted as required by applicable law.

23. Changes to these Terms

The current version and effective date should be displayed on the website. Changes may apply prospectively after reasonable notice.

A material change must not be applied retroactively where doing so would unfairly reduce a visitor's accrued rights or increase previously accepted obligations. Fresh affirmative acceptance must be obtained where required.

24. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except where mandatory law requires another result.

A governing-law or forum clause must not deprive a consumer or other protected user of mandatory rights, access to a competent court or the ability to complain to a regulator.

Before starting formal proceedings, a visitor may contact legal@hashtag.bio so the concern can be reviewed. If a dispute is not resolved, proceedings may be brought in a court with lawful jurisdiction. Consumers may use the courts and remedies available under mandatory law in their place of residence. This informal step does not suspend a legal limitation period or prevent urgent or regulatory action.

25. Electronic communications

Notices and records may be provided electronically where permitted by law. When affirmative acceptance is required, the website should retain the applicable version, date, time and acceptance event.

Electronic acceptance of these Terms does not constitute consent to promotional marketing or to receive communications through every available channel.
